1. This website

• The site is published by Windshore Place Hospitality Limited and describes a hotel at 74 Oriental Parade, Wellington.
• No gambling takes place on this website. There is nothing here to play, nothing to download, no account to open and no money to deposit. The Windward Room can only be played in person on level two of the building, by people aged 20 and over.
• Rates, hours, menus and package contents change. We keep the site current and we correct errors when we find them, but a page is not an offer capable of acceptance. A booking exists when reservations confirms it in writing with a number.
• Photographs are indicative. Rooms of the same category differ in outlook, layout and furniture.
• Text, photographs and design on this site belong to us or are used under licence. You may quote and link to it; you may not republish it wholesale.
• Links to other sites are for convenience. We do not control them.

2. Bookings

• The lead guest must be 18 or over. Guests under 18 must be with a responsible adult.
• The enquiry form does not make a booking and takes no payment. It starts a conversation; reservations replies with what is available and what it costs.
• Occupancy is limited to the number stated for the room category. Cots and rollaways are subject to the room and must be asked for in advance.
• We may decline or cancel a booking where it is made fraudulently, where the guest has previously damaged the property or abused staff, or where we cannot lawfully accommodate it. Money taken is refunded in full.
• Groups of five rooms or more are handled under a separate agreement with its own deposit and cancellation terms.

3. Rates and payment

• Rates are in New Zealand dollars and include GST at the rate in force.
• Published "from" rates are the lowest available in that category and are not available on every date.
• Breakfast at Chaffers, the lap pool, sauna, steam and wireless are included in every room rate.
• Parking, the airport car, spa treatments, in-room dining and the bar are charged separately.
• A card is taken at check-in as security for incidentals. A pre-authorisation of NZ$100 a night is placed and released on departure; banks commonly take three to five working days to clear it, which is their timing and not ours.
• The account is settled on departure unless a company account has been agreed in advance.

4. Changes and cancellation

• Flexible rates — cancel or change free of charge up to 48 hours before the arrival date. Inside 48 hours, one night is charged.
• Advance purchase rates — paid at booking, not refundable and not changeable. The rate says so before you confirm it.
• Packages — free to 72 hours before arrival; inside that, one night is charged. We will move a package once at no charge, subject to availability.
• No-show — the first night is charged and the rest of the booking released.
• Early departure — the nights booked are charged unless the room can be resold.
• If we cancel — if we cannot honour a confirmed booking, we will find you a comparable room in Wellington, pay the difference in rate for the nights booked, and pay the taxi.

5. During your stay

• Check-in from 3pm; check-out by 11am. Reception is staffed twenty-four hours; late arrival is not a problem if you tell us.
• The hotel is entirely smoke-free indoors, including balconies below level seven and including vaping. A cleaning charge of NZ$350 applies where a room has been smoked in, and it is not a fine — it is what taking a room out of service to air and re-launder it costs.
• Assistance dogs are welcome everywhere at no charge. Other dogs are accepted in eight designated rooms at NZ$45 a night, by prior arrangement, and may not be left alone in a room.
• Please keep noise down between 10pm and 7am. Persistent disturbance may end a stay with the night charged.
• Guests are responsible for damage beyond fair wear, charged at the cost of repair or replacement with the invoice shown to you.
• Lost property is held for ninety days and couriered at cost.
• Cameras cover public areas and never guest rooms, bathrooms, changing rooms, the pool hall or treatment rooms. See the privacy policy.

6. Restaurants and bar

• Roseneath holds a booking for fifteen minutes past the time.
• Tables of eight or more at Roseneath are asked for card details; a cancellation inside 24 hours is charged at NZ$40 a person.
• The tasting menu is for the whole table and must be ordered by 8pm.
• The terrace opens when the wind is under about twenty-five knots, judged at 4pm. Terrace seats are confirmed on the day.
• The Carter takes no bookings and holds forty-six seats.
• Alcohol is served under the Sale and Supply of Alcohol Act 2012. Identification is asked for where staff judge it necessary, and service is refused to anyone intoxicated.

7. The Windward Room

• Entry is restricted to people aged 20 and over under the Gambling Act 2003. Photo identification is required on every visit.
• Gaming is conducted under the Act and under game rules approved by the Secretary for Internal Affairs. The rules of every game are available at the cage.
• Table minimums and maximums are posted at each table and may change between sessions. They do not change during a shoe or a spin.
• No credit is extended for gambling to anybody, and gaming cannot be charged to a room account.
• Card purchase of chips at the cage is limited to NZ$1,000 a person a day.
• The room opens at 11am and closes at 3am, seven days. Last entry 2:30am.
• Management may refuse entry, ask a person to leave, close a table or void obviously erroneous play. A decision of the duty manager is final on the floor; a complaint about it is dealt with under section 11 of the host responsibility policy.
• Self-exclusion is available at any time — see the host responsibility policy. Entering while excluded is trespass.
• Package gaming credit is issued once, at the cage, against room and identification. It has no cash value, is not transferable, cannot be topped up or matched, and lapses at the end of the stay.
• Photography and video are not permitted on the gaming floor.

8. Events

• Events are confirmed by a signed agreement with its own deposit, minimum spend and cancellation schedule, which prevails over this page where the two differ.
• Final numbers are needed five working days before the date and are the minimum charged.
• Outside catering is not permitted. Celebration cakes are, at a NZ$4 a head service charge.
• Terrace ceremonies have a wet-weather alternative held for you at no extra cost. The call is made at 9am on the day, by us, and it is not negotiable at 4pm.

9. Liability

• Nothing here limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where you deal with us as a consumer. Where you deal with us in trade, those Acts are contracted out of to the extent the law allows and it is fair and reasonable to do so.
• We are liable for loss caused by our own failure to take reasonable care. We are not liable for indirect loss, or for events outside our control — weather, earthquake, strike, failure of a public utility, or an order of a public authority.
• Valuables should go in the room safe or the safe at reception. Our liability for property not deposited at reception is limited as the Innkeepers Act 1962 provides.
• Vehicles are parked at the owner's risk. The valet garage is not ours.
• Use of the pool, sauna, steam room and gymnasium is at your own risk. The pool is not lifeguarded and children under 16 must be with an adult.

10. Law and disputes

These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction. Tell us first — write to [email protected] or ring +64 4 894 2100. We acknowledge within five working days and answer within twenty. Most things are settled the same week.

Gambling matters may also be taken to the Department of Internal Affairs at any time. Privacy matters may be taken to the Office of the Privacy Commissioner. Neither requires our agreement and neither requires you to come to us first.
